Terms of Use

1. Acceptance of these terms

By creating an account or using tudy (tudyapp.com.br), you confirm that you have read, understood and agree to these Terms of Use. If you do not agree with any part of these terms, do not use the service.

These Terms of Use are a legal agreement between you and tudy. We recommend reading them in full before using the service.

These terms are a translation of the original Portuguese version (Termos de Uso). If the two versions differ, the Portuguese version prevails.

2. Description of the service

tudy is a productivity and organization web app for students. On the platform you can organize subjects, tasks, deadlines, notebooks, flashcards, topics and study sessions with a timer, and keep track of your progress.

The service is accessed through the browser at tudyapp.com.br and can be added to your device's home screen. tudy is not distributed through app stores. The product is in active development, which means new features are added often and some may be changed or discontinued.

3. User accounts

To use tudy you need to create an account with a valid email address. You are responsible for:

• Keeping your password confidential and not sharing it with anyone
• All activity carried out with your account
• Notifying tudy immediately of any unauthorized use of your account
• Keeping your account information up to date and accurate

tudy reserves the right to suspend or close accounts that violate these terms, use the service in an abusive or fraudulent way, or manipulate the leaderboards and scoring.

4. Plans and pricing

tudy offers two plans:

These prices apply when you use tudy in English. If you use tudy in Portuguese, prices are in Brazilian reais, as described in the Portuguese version of these terms.

Prices may change with 30 days' notice by email to active subscribers. A change will not affect the billing period that is in progress when the notice is sent.

5. Payments and subscriptions

5.1 Payment processing

Payments are made by card and processed by Stripe, which is PCI DSS certified. tudy does not store credit card data on its servers.

5.2 Renewal

Your subscription renews automatically at the end of each period, monthly or yearly, on the card on file, unless you cancel before then.

5.3 Cancellation

You can cancel your subscription at any time from your account or by contacting contato@tudytech.com.br. After you cancel, you keep access to Pro until the end of the period you have already paid for. There are no prorated refunds for unused periods, except where applicable law requires otherwise.

5.4 Failed payments

If a charge fails, we will notify you by email. If the payment is not resolved, your account will go back to the Free plan at the end of the current period.

6. User content

You keep the intellectual property of all the content you create in tudy: tasks, notes, notebooks, flashcards and other records. By using the service, you grant us a limited license to store and process that content for the sole purpose of providing the service to you.

You are responsible for making sure the content you create does not violate third-party rights or applicable laws.

7. Acceptable use

You agree not to use tudy to:

• Violate applicable laws or regulations
• Try to gain unauthorized access to tudy's systems or data
• Interfere with or harm the operation of the platform
• Reverse engineer or copy tudy's software
• Create fake accounts or multiple accounts to get around the limits of the service
• Insult, harass or expose other people in the social features, such as friends, leaderboards and team projects

8. Service availability

We make reasonable efforts to keep tudy available, but we do not guarantee uninterrupted availability. The service may be unavailable because of maintenance, updates or events outside our control.

Because tudy is in active development, features may be added, changed or removed. We will let you know by email about significant changes that affect the paid plan.

9. Limitation of liability

tudy is provided "as is", without express or implied warranties of fitness for a particular purpose. To the fullest extent permitted by law, tudy is not responsible for:

• Loss of data caused by unintentional technical failures
• Indirect, incidental or consequential damages arising from use of the service
• Temporary interruptions in the availability of the service

Under no circumstances will tudy's total liability exceed the amount paid by the user in the last 3 months.

10. Privacy

The use of your personal data is governed by our Privacy Policy, which is an integral part of these Terms of Use.

11. Changes to these terms

We may update these Terms of Use from time to time. We will notify you by email at least 15 days in advance of any significant changes. Continuing to use the service after the changes take effect means you accept the new terms.

12. Governing law and jurisdiction

These terms are governed by the laws of the Federative Republic of Brazil. Any disputes will be settled in the courts of the user's place of residence, as provided by Brazilian law.
